They didn’t actually create any rule or test for when the presumption is overcome. They just looked at “can he ask the Vice President to overthrow democracy” and went “gee tough question”

So now the DC Circuit and Judge Chutkan can hold their own hearings and findings and scotus can take it again and say “nope you did it wrong!” What a crock of shit. They invented this from whole cloth because they’re the type of partisans who fly upside down flags when a democrats inaugurated.
