EXACTLY! SCOTUS tried to hit it out of the ballpark, but basically said "maybe yes, maybe no. Crimes no - but hey, appeal if you want to commit them anyways." We've always had this level of presidential immunity: *nothing* changed. SCOTUS should not have taken the request for such a habby outcome.
Can the Senate or the DOJ do anything about the fact that Thomas and Alito did not recuse? It would still be 4-3, but Barrett's position would be the compromise.
