So, people loudly advocate for the death penalty all the time. Is it incitement to call for the president to kill somebody if he can do so legally?

Incitement requires imminent lawless action. Here - not imminent, so not incitement. What is not clear to me is whether or not it is lawless. Is it criminal, but the president can't be charged, or is it not criminal because the president can't be charged?
