SCOTUS knows Delaware Joe would never do this, but that Donald Trump absolutely would, and especially if people were protesting outside the Thomas or Alito home.
That's the whole problem. Dems have unilaterally disarmed too many times on too many issues and now the GOP has no fear of changing the game and ending all the guardrails.
They're counting on it. If there was even the slightest chance that Biden would be doing any of this stuff, the court would be having a completely different discussion, I can guarantee you that.
