I have practiced in front of Judge Kaplan. He does not suffer fools at all, let alone gladly.

With Judge Kaplan, you bring your A+ game or suffer the immediate, blunt-force consequences

For the benefit of any lay person who may have wandered through this thread, are there any remaining avenues of appeal?

All of these rulings can be appealed. In my training and experience (30 years as a federal trial attorney), I believe that Judge Kaplan has done an exceptional job of "appeal-proofing" this verdict. The only thing I know *for certain* about the future is that it has not happened yet. We'll see.
