Another brick in the wall that is being built by the prosecution in New York v. Trump. h/t @klasfeldreports.bsky.social

As a defense attorney, is there a plea deal to be made? I recall you saying that incarceration was not all that likely in this case, so a plea deal might be a quick way to end things. It'd not affect a single MAGA vote anyway, and it would not hurt with the non-MAGA Republicans.

With virtually any other defendant, I would have expected a guilty plea and a recommendation for a non-custodial sentence.

I'm guessing the defense would be willing to plead to a couple of misdemeanors and is balking at the felony.

I do not know. If by “the defense”, you mean the attorneys, that is what they would typically counsel. If by “the defense” you mean FPOTUS himself, I have literally no idea what he thinks. He has said, repeatedly, that he “did nothing wrong.” What he says does not correlate with what he thinks.

The defense opening statement included a denial that Trump had had a sexual encounter with Stormy Daniels, which, in effect challenged the prosecution to prove that. It was imho unnecessary & makes their case more difficult--it's that kind of stuff Trump insists on. So I doubt he'd plead to a crime

Can you provide a quote from the opening statement? I have been unable to find it, but my eyes are weak and my patience short.

Though I might add that in my (long ago) experience as defense counsel, white collar criminals were the most delusional when it came to understanding how much legal jeopardy they were in.
What sort of acknowledgement of guilt or the facts of the offense would have been required of Trump in this case, given this is a state court?

A full allocution to every element of the crime is required as part of every felony guilty plea in New York courts.

Regardless, I can't imagine Trump *ever* taking a plea deal.
Any plea deal would also be likely to have negative political consequences. "Trump admitted to committing crimes" would have salience for some undecided voters/anti-Trump voters who might not otherwise vote. Even if not a ton of people, 1 or 2% of the voters matters and 5% would lock the election.

He settled the Trump U. case. Granted that was a civil case, but to put the only trial that will dog him through November, to rest, maybe he will.

The funny thing is I heard that Trump refused to use email because he thought, rightfully, it'd leave a digital paper trail that could come back on him. Yet there he goes, Tweeting his evidence of his crimes. Guess if email came with likes and retweets he would have been busted years earlier?
