Rolling back Chevron won’t undo that or the Federal Food, Drug, and Cosmetic Act of 1938, so labeling requirements won’t go away, but the FDA will have far less latitude to enforce rules that make us all safer

Chevron going away will introduce ambiguity around what constitutes a drug and what is considered a supplement though and the latter are very poorly regulated.

In addition, rule making is used to set standards for clinical trials. It’s used to get pharmaceutical companies to play ball on post-market drug safety monitoring. The law is intentionally vague to allow this because neither congress nor the courts have the technical expertise to set these.
