Federal court judge explaining how to find porn online. assets.freespeechcoalition.com/documents/le...

'Minors could also just search terms like "hot sex"' GROSSLY irresponsible to give away these highly technical tricks of the trade in a public legal opinion that teens could read and learn how to hack the system!

Your assignment, should you choose to accept it, is how to transform the teen's behavior after their parents explicitly warned them, into a federal felony under the current judicially accepted interpretation of 18 U.S. Code § 1030 (the CFAA).

It is a truth universally accepted that being a kid is an offence.

You can barely get most *lawyers* to read past the syllabus/headnotes, so maybe it's safely buried in plain sight.
Avatar
This opinion violates several statutes' definitions of "harmful to minors"

i was thinking exactly that...

I remember an early magazine article (maybe in Time?) about kids finding porn on the Web (capital W, back when one surfed the Web) had blurred out screenshots of the stuff you’d find, but didn’t blur the URLs at the top of the browser they screenshotted

This is the article that inspired Senator Exon to write the Communications Decency Act, which was eventually thrown out as unconstitutional, leaving behind a little thing we now know of as Section 230 (which had been written as an alternative to the CDA, before Congress merged them together)

In defense of His Honor Judge Dick Young, “lazy apathetic sex” does not yield porn in its search results.

Yeah man, I tell ya what. That dang ol' internet man. You just go out on there and point and click. Yeah and talk about w w dot w com, man. You got them naked chicks on there, man. You go click click click click click click click click. It's real easy.
Avatar
Wait, there’s people who need to be told how to find porn?
Avatar
No. They know. They just need it in the record so they can point to it for how ineffective these stupid id laws are.

See the Chevron ruling was nothing - judges got this expert stuff down pat!

And here I was losing faith in the judiciary today

What is this nonsense? IP addresses have a 60 mile radius?
Avatar
Wait what. Whoever thought it was a great idea to allow judges to designate themselves experts in everything, that person must be fired immediately.
Avatar
I'd have to look at the citation but I wouldn't be shocked if this is a pretty good estimate for the reliability of geoIP databases.
Avatar
as a ballpark, I kinda just assume a geoIP lookup is good down to like, "major metro"
Avatar
I'd be really interested to see what the citation says. It might say there's an AVERAGE of 60 miles and that's been misinterpreted. Surely there are national ISPs whose IP addresses aren't tied to physical locations, for example?
Avatar
Unlikely. Some of the addressing is going to be tied to the network topology unless you deliberately avoid doing so.
Avatar
I'm not a network engineer so I can't really give a concrete example, but it's pretty easy to just try various IP addresses from your friends across the country and see how geoIP resolvers register them
Avatar
Well, see the Constitution has this bit about lifetime tenure…

It has a *lot* of stuff that's been ignored.😄

Children can also use their hands to draw boobies and wieners on the backs of their math homework (!!)

Gee, a century of antintellectualism has made geniuses out of so many Americans in all walks of life!

The lack of mention of VPN is embarrassing.
Avatar
Oh there's a whole section on VPNs. And Tor. I was only covering the searching section.
I think there's a decent argument to be made that minors using random "free" VPNs is probably very bad ( though predictable ). Are there even 10 that aren't doing surveillance and/or fucking up the encryption?
