It’s the way the Roberts opinion praises itself for not deciding what an “unofficial act” is right now, while hamstringing any attempt to prove what one is in the meantime, and very loudly ignoring that any answer they dislike will just be overturned by them later

i look forward to debates over this, which given US power projection, will no doubt come sooner or later

is torture an official act? are war crimes? both are criminal under U.S. law. what happens to presidential command responsibility? also, if POTUS is immune from prosecution, there is no complementarity. the court has made it easier for the ICC to pursue cases ag american presidents.

Which is why any thoughts that this decision gives Joe Biden any kind of power or cover are just wishful thinking. 🙄

It's also for other Republicans, as well, and in particular this is a huge threat even post-Trump GOP.
