occurs to me that bribing the president is now /always/ legal, since in every case the only way to distinguish gratuity from bribe is via evidence that could never be admissible

The president owns the privilege though right, so could waive it if they wanted you prosecuted?

The president /doing the offense/ owns the privilege, rather than the president per se

Ah quite. But it also becomes a powerful cudgel against the briber: if you fall out of favor, or if the president wants people to think they are against corruption, you can be in trouble at their whim

Fun question to think about: if this is the (former) president's personal privilege, and it precludes the introduction of evidence in the trials of others too, what happens when the president dies?
