It seems incorrect to read #2 as anything other than "we'll have more for you later, we're working on it" and I would recommend that they should be very diligent on it because of the amount of people freaking out about what's pretty normal language here.

basically every lawyer I've talked to on or off here is stunned by how bad it is, I think most folks expected some sort of "come up with an official acts test" punt but it's about as bad as it could possibly be
I think at this point there have been enough choices by the usual suspects to upend precedent and *not* offer a replacement standard that they see the resulting inconsistency across districts as a positive.
