Good point from Sotomayor here. By barring prosecutors from probing a president's intent, Roberts renders the entire "official vs. unofficial" distinction meaningless.
Note that these laws also harm public safety, because they divert prosecutor & public defense resources and clog the courts with cases against people who aren't a threat. Not a constitutional issue. But a significant one.

Interesting tidbit -- DeSantis's war on progressive prosecutors is prompting DAs to avoid diversion, and to pursue petty cases. That's diverting resources away from more serious crimes -- in a system in which courts, DAs and public defenders are already short-staffed and under-resourced.

Not paying to read this article. Just want to note this: Ronald Reagan praised the Marielitos as brave anti-communists fleeing oppression. Castro called them criminals, mental patients, and dregs of Cuban society. It's interesting which characterization has since taken hold on the right.
