Isn’t to a crime to make people think you’re going to shoot them? Like if I went out and pulled out a prop gun and pointed it at someone and pulled the trigger I’d probably be arrested, right?

You would be surprised as to what the Second Circuit already clearly established as a deprivation of rights. (It's probably the best Circuit on this issue)
