I think Brown underscores what a tenuous thread EMTALA is. Doctors (and, importantly, clinic/practice/hospital shareholders) still know that anything they do can be litigated as crossing the imaginary boundary of necessary-for-health.
I mean, yeah, it absolutely is a necessity, but also fuck.
