Invoking Holmes's hoary quote while leaving out the 'falsely' is an ironclad guarantee that you're being set up for a terrible argument for restricting speech on nakedly viewpoint-based grounds, and Bobo's op-ed is certainly no exception www.lawyersgunsmoneyblog.com/2024/06/the-...

The reason why people lived in constant fear of violence during the English Civil War was because of the Crown's ability to legally enforce subpoenas
It's striking how since his MAGA turn Taibbi's prose has steadily devolved into the kind of muddle of inapt cliches and mixed metaphors he used to make fun of Thomas Friedman for

I recommend this @steve_vladeck post in its entirety, and especially the point that by deciding things it doesn't need to decide the Court is not only providing de facto immunity to Trump but creating a roadmap for future presidential misconduct: stevevladeck.substack.com/p/78-writing...
As badly as Burger handled it, Nixon v. US did two crucial things: 1)allow the immediate case to go forward and 2)leave questions of executive privilege to mostly be sorted out by future cases with actual facts. The Roberts Court seems poised to bat .000 here

Both Trump and the anti-abortion lobby are completely open that the "states' rights" line is pure kayfabe. The latter will not tolerate women having reproductive rights anywhere in the U.S. If you don't know this it's because you don't want to know www.nytimes.com/2024/04/08/o...
At this point reporters falsely claiming that Trump came out against a national abortion ban aren't so much marks as in on his con www.lawyersgunsmoneyblog.com/2024/04/see-...

Hamilton's defense of the Electoral College in Federalist 68 now makes some students in my presidency class laugh out loud
All this nonsense post-2016 about how Trump's victory illustrated the dangers of the democracy when most people voted against him. Twice now. Meanwhile the holy institutions we're all supposed to be praying to and prostrating ourselves before have saved or elevated him at every opportunity.

What the reporter fails to point out is that if there is no Electoral College majority the election is thrown to House *state delegations,* which means Trump would win 100% of the time and no third party would have an iota of leverage over the outcome
The NO LABELS plan to influence the outcome of teh election is absolutely moronic nonsense that shows no understanding of how the electoral process works www.lawyersgunsmoneyblog.com/2024/03/no-l...

All of which is the appropriate context for ACB whining about the "stridency" of the justices willing to put their name on their opinion in defense of the justices who weren't:
As @jbouie.bsky.social observes, the majority's claim that the federal judiciary cannot enforce Section 3 is particularly farcical in light of its nullification of Congress's explicit power to enforce the next Civil War Amendment in Shelby County. Just pure Calvinball: bsky.app/profile/jbou...
Avatar
And the majority's holding that Section 3 is not self-executing because Congress is given what is plainly the concurrent and not exclusive authority to enforce it is transparently wrong:
As the joint concurrence observes, the majority's holding that Section 3 can only be enforced by specific legislation has the intention and effect of "insulat[ing] all alleged insurrectionists from future challenges to their holding federal office"
