Rebroadcasting a game without the express written consent of Major League Baseball, obviously.
Okay, folks, who is putting together the list of the funniest crimes that Biden should be committing between now and election day to highlight the absurdity of today's immunity ruling? Not the stuff like assassinations. Just stuff to make a point.

@davidjroth.bsky.social I was browsing the list of autograph-signers at the National Sports Collectors Convention, and it is quite an assemblage of legit HOF Dudes plus several Guys and some random "played in Clevelands," but I guffawed at the "Entertainment" list. www.nsccshow.com/autograph-gu...

Why is the "the" in "The Chief Justice" capitalized but the "the" in "the Court" is not?

I was thinking about criminal statutes that rely on agency regulations, and separately thinking about criminal statutes with jurisdictional elements, and realized that "SORNA" and "arson" are acronyms, and I dunno, that's about as profound as I can get today.

I guess with Likes going away on Twitter, no one else will ever grab the same screenshot I did of a very prominent legal community figure (not a judge, but more well known than many judges) liking a porn video back in 2022.

@davidjroth.bsky.social Just watched on Prime and felt compelled to tell you about NIGHT GAME (1989), with Roy Schieder as a Galveston cop hunting a killer who is fixated on the Astros. Caught mentions of Bonds, Bonilla, Mike Marshall, Jim Leyland, and Rafy Ramirez. A Yogi sighting, too!

If you wrote a novel about a prison so cold that toilet water turned to ice and multiple prisoners had to be hospitalized for hypothermia, people would say it's unrealistic. And that's before you get to the guards allegedly opening windows to make it colder for punishment. wjla.com/news/local/v...

Saw "The Fall Guy" today and had a hell of a lot of fun. I thought it was a blast; best time I've had at the movies in a long time. In a few years, lots of people will say they always liked it -- you can get in on the ground floor and see it now!

New one for the legislative acronym hall of fame: the “Creating Additional Seats to Ease Legally Overburdened Adjudicators’ Dockets Act of 2023 (CASE Load Act of 2023)." No idea why only "CASE" is capitalized there.

Randomly recalled back before law school when I was doing a little teaching and how the high school English students' favorite line from "Macbeth" was "Screw your courage to the sticking place, and we'll not fail," so that's been in my head all day.

I can't believe that They Might Be Giants wrote TWO songs about the sun, and neither one made this list! Why Does the Sun Shine? (The Sun is a Mass of Incandescent Gas): youtu.be/3JdWlSF195Y?... Why Does the Sun Really Shine? (The Sun is a Miasma of Incandescent Plasma): youtu.be/sLkGSV9WDMA?...
so it turns out there are a lot of songs that fit when watching an eclipse... so many so, we made a playlist. listen to all of our picks here (yes we have "black hole sun" and "total eclipse of the heart!") wapo.st/3JaYXsZ

There are going to be a lot of A/K/A's on that indictment.

I wasn't even watching this debacle very closely, but I did predict this outcome:
I have not followed this closely enough to know if this is even an option, but would a Solomonic compromise be to disqualify *Wade" and not Willis?

"The Rewatchables" podcast is fine for what it is, but what I really need is a list of movies with a stellar first half-hour for nights when I'm not ready to go to sleep yet but don't want to stay up for a whole movie.

I have a feeling that the Supreme Court's upcoming decision in Trump v. Anderson will be cited a whole lot by attorneys arguing about constitutional interpretation, and cited by the Court itself almost never.

I applied for a judgeship, and even though I probably had no shot, I'm glad I did it. It made me do a real scrub of my work history, I got to practice interviewing for the 1st time in 15 yrs, and met lawyers from around the state from the various groups that make recs to the Senators. Take a chance!
Hey you, progressive lawyer who thinks you could never be a federal judge bc you’re not a douchey ambition monster or a MAGA zealot, please apply! buff.ly/4bd4egB

Every part of this article about harvesting organs from Alabama prisoners is awful, but this bit just shows how badly they mistreat these people even before they die. andscape.com/features/ala...

One thing I'm most proud of is being able to say I was one of Judge Wilson's clerks. He's a role model and a model judge. I hope he has a long, relaxing, well-earned retirement. (And if I can suggest a successor, the White House should consider my co-clerk, Magistrate Judge Amanda Arnold Sansone.)
New: Eleventh Circuit Judge Charles Wilson, based in Florida, will assume senior status on December 31. Biden has appointed one judge to 12-member court (Nancy Abudu).

As an appellate attorney, I think about this question a lot, as well as the related notion many people have that it's easier to win on appeal than it is at trial.
Why do non-lawyers think everything is appealable?

My in-laws' microwave displays "Enjoy your meal" when it's finished. For a Hot Pocket, it should be something like "Are you sure?"
The microwave in the firm’s kitchen issues a jaunty little celebratory tune when it finishes cooking that sounds entirely inappropriate to the occasion of eating a Hot Pocket for lunch. Should be “here’s your extruded meat product to eat while you draft a reply brief, WHOMP WHOMP”

I get that most White House-Pentagon communication is lower-level, and POTUS doesn't need to talk to Sec'y daily. But this is a very bad look, not least because it makes Biden look out-of-the-loop. Resigning now would at least forestall a trickle of more bad stories and speculation and what-ifs.
Not entirely sure what the right response to this is, but SecDef keeping his incapacity from NSC is pretty deep into "wtf were you thinking" territory
