These judges are politicians and they are very worried that their actions are sparking an effort to curtail their power. This fear should be the baseline for the country's relationship with SCOTUS, and I'm glad that the shift that direction is getting results.
Especially with the Alito and Thomas stuff coming out right now I’m guessing they’re thinking to themselves, “Let’s pump the brakes right now”. Plus there’s little constituency for mifepristone bans and a major election fast approaching.
So stripped of all the legalese, if I’m reading it correctly, the opinion is “this is bullshit and never should have made it this far, the plaintiffs lack standing, and why are you making us do this?”
They know the ramifications of things in the long term. This is why I am cautiously optimistic about the immunity case. The Supremes understand that giving Presidents unlimited immunity destroys their power to control policy in the US.
