It’s all 100% masks off at this point, lads.
Judge Cannon went and did it. She has dismissed the stolen documents case against Trump on Clarence Thomas’s (nonsense) appointments clause rationale.
Avatar
It really feels like we’re exiting the previous era of plausible deniability and entering a new era of corrupt rulings begetting more corrupt rulings.

Basically every ruling by any tRump judge or conservative court is a dare.
Avatar
Not all of them, but for those judges who didn't play along, they retroactively became Democrats. (At least according to Republicans.)

Ken I know you made a sarcastic point about this yesterday, but it is starting to feel that in politics and in law intellectual consistency just doesn't have any value anymore

You're just saying that because it's true.

DOJ authorized Jack Smith to appeal Cannon’s dismissal. How the 11th Circuit decides will affect “the entire framework of how special counsel investigations are conducted in the future.”
Jack Smith responds after Aileen Cannon rulingwww.newsweek.com The justice department has authorized the Special Counsel to appeal the court's order," said Smith's spokesperson.

Precedent is for losers who play by rules.
Avatar
“How the 11th Circuit decides will affect “the entire framework of how special counsel investigations are conducted in the future.”” -Will make this irresistible to SCOTUS. Which can’t bode well for Jack.
Avatar
Honestly, will this matter? Won’t it just end up at the Supreme Court where they will agree with Cannon? She must have earned herself a lil Winnebago this week.

Perhaps I am overreacting, but I take this as raising your whole stake in poker. They believe 2024 is their last, greatest chance to completely remake the government and constitution to their liking, so they aren't going to just "tease it" anymore. They are all in.
Avatar
The rare case where shit posters were right when all the law pundits told them they were wrong.

Avatar
Is this appealable? I mean, we all saw the evidence. I guess delaying was the point, so this is kind of moot, but if Biden wins I'd love to see Trump go to trial for this.
Avatar
Avatar
can't wait for this to get appealed to SCOTUS where we learn that trump's name has been scribbled into the constitution in crayon as president-king
Avatar
Surely God king president for life El douche
Avatar
And the 11th overruled Cannon on something similar before she was even assigned the case as I recall.
Avatar
Is there any way to get the decision reverse and/or get a different without getting SCOTUS involved??? Wishful thinking?
Well. If Jack Smith was waiting for Cannon to do something wacky enough to get her taken off the case on remand, the wait is over.
Avatar
Jack Smith is not playing 3D chess against naked fascism.
Avatar
He should lay low and avoid looking overtly political or acting with unwarranted aggression.
I like the thought, but there are deadlines that require actions or else the right to appeal is lost.
Avatar
I was joking. He's got nothing to lose. He must appeal immediately & ask for Cannon's recusal. trump's legal cases need to be in front of the public now. If the appeal is shot down, leak all of the evidence to the press & public. America needs to know what crimes he committed. We are all jurors.
Avatar
She slow walked the case from the day it was filed and then dismissed it on the opening day of the republican convention. Calling her a partisan hack is being too nice to her.

Don't make me tap the sign again. bsky.app/profile/did:...
LOL. Every time lawyers try to explain this and that, because the law/constitution says this and that, and the average shitposter said "but it doesn't matter, they're all corrupt to the core", the shitposter turned out to be right.

The mobbed up federal judge installed to save Trump followed the lead of the rogue SCOTUS justice who's been bought with millions in bribes and who visited Putin's palace via yacht with Harlan Crow. This is treason against the United States and our Constitution. Nothing less.

I don't particularly feel like coming together in unity, or turning down the temperature.

What a great birthday present for me. \s

Happy birthday. Pretend the Republic burning is candles!

That skeet is 2 words too long at the end, and one word too long just after the colon.

Merrick Garland should be fired today. Also Wray and DeJoy, but especially Garland.
Avatar
Wray even before Garland imo Can we allow anyone in Fed Soc to remain in position to Jason Miller?
Avatar
Why won't anyone do anything? Why do the bad guys just always get to win?
Avatar
Because we keep expecting them to follow the rules, when they're busily finding new ways to bend the rules to their favor...
Avatar
"Bend"? That's generous. I think we're well into "ignore or rewrite" territory.
Avatar
It does really seem that way.
Avatar
It's only cheating until their friends change the rules so it's not.
Avatar
Your profile says you're GenX like me - I wonder sometimes if GenAlpha will be raised on children's media where the good guys don't win they just...don't die every episode.
Avatar
I'm personally annoyed by the need to give every villian a tragic background and a redemption arc. Some folks need to be reassured that they'll be forgiven when they go evil...
Avatar
If you can't win by the rules of the game, change the rules of the game.
Avatar
Too late for Hunter Biden to try to get his case reassigned to Aileen Canon?
Avatar
It won’t work bc Weiss was former US Attorney and thus was senate confirmed so it’s ok by this farcical argument (if one care about logic and fairness et )
Avatar
Is this the type of ruling for which DOJ could request an expedited appeal to the 11th Circuit? I assume even if an appeal went DOJ's way, the case would be gummed up in the courts for a long time?
Avatar
Unlikely to get expedited, yes would take a long time.
Avatar
Any chance they're so pissed off by the blatant fuckery on display they do it tomorrow?
Avatar
Conversely, I saw one speculation that DOJ could immediately appoint Smith an AUSA & he could carry right on. IANAL so not sure how viable that option would be, but sounds like fun. lol
