1) fitting that Gorsuch, a notably cruel jurist, has the majority opinion here 2) another vindication of my view that the conservatives on the court are re-inflating the police powers of states to regulate public behavior and morality as they please
First decision is Grants Pass. Gorsuch has the 6-3 opinion finding that the Eighth Amendment does not bar "generally applicable" laws banning public camping. Sotomayor writes the dissent. www.supremecourt.gov/opinions/23p...

It's great that we have a super parliament of unaccountable, unelected judges, and that they have all the vision, generosity, and sense of proportion of a below average HOA

"Generally applicable" is literally "the law bars the rich and poor alike from sleeping under bridges..."

the conservative agenda: increase policing powers to enforce their vision of community, while degrading the government's operation power to serve the community

In another country this ruling would say it's illegal to have homeless people sleeping rough *because the state should provide housing for all*.

He does love freezing people to death.

except now the guy in the truck cab slowly freezing to death could have been *arrested* if he fell asleep, sending him to a nice warm jail cell (and simultaneously being fired for not being in the truck cab.)

I wonder how many self-styled libertarians will be upset about this decision.

None. Libertarians are fence sitters whose sole purpose is complaining about how the wind blows knowing they’ll never be held responsible for it.

As they strip away the concept of rule of law through contradictory, outcome-driven decisions, they must ensure the state's capacity to inflict violence on those it seems inferior remains unobstructed. Lawlessness walking hand-in-hand with cruel restrictions on citizens' lives. Federalist Freedom

I.e., decimate the rights of individuals against the state.

FWIW, I think the angle plaintiffs should be taking is due process, not the 8th Amendment, but that's also an uphill fight.

Gorsuch’s opinions on tribal rights might be the only evidence he has a soul at all.

Jamelle, you are correct: you've named their deeper agenda.
