It's a two-box day at SCOTUS, so we are expecting between two and four decisions.

First decision is Grants Pass. Gorsuch has the 6-3 opinion finding that the Eighth Amendment does not bar "generally applicable" laws banning public camping. Sotomayor writes the dissent. www.supremecourt.gov/opinions/23p...

The Grants Pass law, as Sotomayor made clear in dissent, went further, banning public sleeping with any covering, so much as a blanket, even when no other options are available. This is a very troubling ruling.

Sotomayor looks to the "near future" for different action from the court:
Avatar
After Gorsuch read extensively from his opinion, Sotomayor is reading from her dissent. "Sleep is a biological necessity," she begins, "not a crime."
she's correct; so sick of this cruel court
Avatar
Ah, but cruelty is part of our history and tradition.
I’m tempted to move to a two seater bench in Grants Pass. Where will the homeless go once the jail is full?
Avatar
Jails will never be "full" where jails are run for profit.
Avatar
Oregon already don’t have for profit jails.
Avatar
They’ll always find funds for more jails unfortunately
Avatar
Not in Grants Pass they won't. When I lived down that way, the Sheriff's Office was practically non-existent because the citizens of Josephine County wouldn't vote for the tax to keep it open.

Any idea if Alito is present? I'd heard he was MIA last week, I think, but I have noted any follow up.
Avatar
Sadly, I think if he was still missing, people would be talking about it more. Ah, well.
Avatar
Kinda what I figured. But I'll continue to hope that he's going to create an involuntary vacancy for Biden to fill before the election.
Avatar
Yeah, what with that interesting term limit the Justices have, and all... what was it again? hm.
Avatar
She’s placing a lot of faith in November (or maybe someone is sick and hiding it)
Avatar
Here's hoping she's hinting at a few terminal diagnosis on the bench! I wish them the best! 🥂
Desmond's work is seminal. Gosh what a shitty ruling. I get that they can move people but to have no responsibility to also house is shameful. I look forward to a better future also.
Avatar
It's murderous, in both intent & application.
Avatar
If this is constitutional, the constitution has failed to grant the liberty it intended.
Avatar
It literally criminalizes being homeless if all cities have a similar then, just round up all homeless and toss them in jail apparently. Like I said it's a big FUCK YOU to the homeless. They do not care about people except to be cruel.
Avatar
Not just that, but it criminalizes being homeless, even if the city doesn't have any homeless shelters.
Avatar
Avatar
My daughter is out there homeless and schizophrenic. This country has no place for the mentally ill or the homeless! Nice “Christian” country we have here.
Avatar
And, like I keep telling people, this will impact the housed too. Now, all that stands between you and, say, being shaped with a fine or jailed, is whether anyone wants to enforce the law on you for taking a nap in the park on your lunch break. Oh, you didn't MEAN to fall asleep? Tough shit.
Avatar
This is going to be expanded to sleeping in you car immediately.

Avatar
I’ve read Thomas’ concurrence. Tell me that his attack on Robinson (1962) isn’t about his desire to clear the way for LGBT identities to return to being status crimes.
Avatar
"The law in its majestic equality," reduced to SCOTUS opinion form, cool
Avatar
Avatar
Well, rich people can't camp in grants pass either.
Avatar
Gorsuch: The law in its infinite majesty forbids both the rich and the poor from sleeping under bridges.
Avatar
So where are they to go? To jail?
Avatar
They literally can't go home, but they can't stay here
Avatar
Avatar
Yes, where they will be put to work on behalf of a corporation. Aka slavery
Avatar
Avatar
Avatar
Hoping so. I’m also hopeful my city keeps its current laws on homelessness since we have been priding ourselves on not being like Portland…. (We legalized outdoor sleeping years before them)
Avatar
It means this Monday no excuses I need to be at the city council to make sure I’m there to protect everybody
Avatar
They can stay in their billionaire-sponsored free luxury campers just like Justice Thomas does, duh.
Avatar
Grants Pass will either slap them with a $295 fine, or put them in jail for 30 days. Since most people stuck in the street don't have that kind of money, they will end up in jail. And I'm sure the jails at Grants Pass are already overcrowded and in absolutely inhumane conditions 🤬
Avatar
The SF Mayor is dying to get to round up homeless who camp in SF.
Avatar
Cool so if every city has this same fucking law WHERE THE FUCK DO HOMELESS PEOPLE GO? I propose these justices many houses
Avatar
They thought about that. The go to prison where they will provide labor for a corporation for Pennies
Avatar
They go to prison, where they will die because our prison system is already stuffed to bursting and overwhelmingly has no a/c or working plumbing or healthcare, and producers are fed where them dogs 2x a day. And COSTS FAR MORE THAN JUST HOUSING THESE PEOPLE!
Avatar
Ugh, this of what happens when I post angry. "Prisoners are fed worse than dogs"
Avatar
The SCOTUS 6 to homeless people, "FUCK YOU" basically
