I've read countless legal briefs from racial segregationists and literal white supremacists but I don't I've never seen anything quite as sneeringly stupid as this.
The complaint is here, but it's one of the grossest things I've read in a while so don't read before eating. I suppose I'm lucky that, as a non-TT person, no one is going to misrepresent me as "unqualified Asian gay man" — yet. www.dropbox.com/scl/fi/2q5ws...

"Faculty hiring at American universities is a cesspool of corruption and lawlessness." This has to rank as one of the stupidest opening lines of a legal document in the history of the American judiciary.

Seems like this graph in WaPo should have gone earlier: "The suit includes plaintiffs that it says could be applicants for jobs at any number of universities, which ... gives them standing to sue “any university we want.” None of the professors mentioned in the complaint were aware of the lawsuit."

So they’re still making up hypothetical situations for lawsuits? These plaintiffs COULD BE applicants; did any of them apply and get rejected?

Well, they seem to be actual situations, but they know nothing about the actual details of the cases. Anyway, I've been on search committees in which we've rejected the most "qualified" person on paper because they didn't fit, tanked the interview, or were utter catastrophes in person.

I’d be interested in what “qualified” means because I’ve interviewed and passed on people who look great on paper but are absolute nightmares as people

I would suspect they haven't even done a comparison of CVs, let alone other qualifications.

Oh, goody! I mean, it's awful, & it's bad for our country that it's out there. But it's been a while since we had some fun #LitigationDisasterTourism from @questauthority.bsky.social or @akivamcohen.bsky.social, & @badlawyerpod.bsky.social always does a good job on sanctimonious lawyer-plaintiffs

My first observation is that the made-for-litigation plaintiff is called Faculty, Alumni, and Students Opposed to Racial Preferences, but I don't think its membership includes any actual Northwestern Law Faculty, Alumni, or Students. I could be wrong.

It's not even supposed to BE a legal brief If I were a judge, I'd make lawyers, out loud & in open court, read Fed. Rule of Civil Pro. 8(a), which requires a complaint to contain "a short and plain statement of the claim," & ask them if they think they complied. Other than that, I'd be a pussycat

OK, so the worst rants I've ever heard from collegues who didn't get the grant/position/whatever barely reaches half-way of that first paragraph (don't plan to read further). And that has been in bars, over significant alcohol, right after the decision.

I'll sit that one out. Out on my balcony, to be precise. Reclining in the pleasant summer evening, in very casual shorts, stroking my greying beard and balancing a white russian on my stomach perfectly dimensioned for precisely this. Strongly recommended.
