The safer and arguably more effective move here was to write an opinion saying "presidential immunity? hmm. Much to consider. Very serious. We would like the lower court to consider these questions but otherwise we are taking no position"

And by allowing "the lower court to consider these questions," they've effectively delayed any possible trial even longer. If the lower court decides Trump's actions were NOT 'official conduct,' you know Trump would appeal that to SCOTUS.

i just don't know how to get people to care. the republicans are spectacularly unpopular and have been for my entire life. if everyone who doesn't like them would bother to show up and vote they would be annihilated from public office
We have to contact who we can, & communicate as well as we can, & trust in the voters. We don't have much more than that. The only way to make them care is for bad people to do bad things, which might well be what happens but I'm not going to encourage or count on it.
I don't know, I think they're waking up. But the Dems need the courage to explicitly run against the court, or it will come off once more as so much thumb-twiddling.
There is a fatally wrong belief, which I have great sympathy for, but can no longer tolerate, that if we obey not only laws but norms, maybe the right will retreat from its thuggery. They won't - they can't. So our obligation is to use the laws aggressively to protect law itself.
