I feel like Chutkan and the circuit are going to be careful and provide copiously argued reasoning, buttressed by evidence on the record. And they'll probably get a bit cheeky with it to.
Of course, the problem is 5 votes have already signaled they're going to take a big shit on that work next cert
I mean, still make them do it. They have so far not been adept at dealing with the easily foreseeable consequences of their rulings without showing their ass more.
these absolute motherfuckers have been making up facts in their cases for 4 years then going home to their little houses with upside down flags chortling like kids who heard a good fart joke
This is what people mean when they say “legislating from the bench.” Not only is the immunity decision horrific in its impact - it isn’t even ruling on the case in front of it!
It’s a terrible decision not just morally, but also procedurally.
What really needs to happen now is for Judge Tanya Chutkan’s hearings with her trial’s witnesses testimony on whether Trumps acts were official or not to be televised, so that all of America can hear the specifics of what Trump tried to do leading up to Jan 6th. Televise those hearings!
