I have no idea the best path re Biden but I do know a solid week straight of “Biden Old” and “Rich Dems Worried” above-the-fold stories are *obscene* in the face of SCOTUS using the Constitution to wipe their asses purely in the service of reinstating a felon rapist as president. Crazy-making shit.

I feel like a lot of the complaints are like: "I'm hungry. I want steak. Biden is offering me gruel TFG is offering me a bullet Neither option is what I want and both will leave me not hungry, so there's no difference"

Eh, I'm no lawyer, I just watch Legal Eagle. It seems this SCOTUS is shitting all over the concept of stare decisis (case law precedent) so there's no such thing as "legal air tight" right now.

I don't believe that would retroactively take effect like that. It's whatever the case law is at the time. Like, I can't do something that's legal, then 3 years later it's ruled illegal, and I'm now legally exposed for something I did that was legal at the time.

I understand the pull of doomerism but I'll also point out that "red-state" organizers and activists have been living under, and resisting/rebuking, many and various forms of oppression for a long time and should be considered leaders in this moment. Like I said back in 2017:

The polls tend to vacillate between 24% and 34%, depending on the specific question. So I call it 30% on the whole. I think that's why generally TFG's floor was 30%, and his ceiling was usually 30%. It's stubborn, and it's too big, but it's also a distinct minority that WILL LOSE if there's turnout.

Furthermore it's something where the enacting of it is ostensibly under his authority, rather than delegating to some other apparatus that could in turn be obstructed by the courts. I absolutely hate thinking about this...

Huh, I wonder if, under this ruling, Biden can imprison the conservative justices, force the remaining back into session, force them to re-hear the case, and issue a new judgement. Obviously a gross idea, but it seems like the least gross way to exploit the ruling, to just undo it.
