There's no longer any ceiling to how wackadoodle Republican lawsuits can go. As @elliemargolis.bsky.social has flagged, the sovereign state of Missouri, being unable to invade or embargo New York, has instead sued it before SCOTUS to try to aid Trump, because ... reasons. ago.mo.gov/wp-content/u...

The last time low-population rural states went to war against high-population industrial states, it did not end well for the former.

The weird twist here is Missouri stayed in the Union the last time...

Look, there's people in *Maine* who fly the Confederate flag and claim it's about "Heritage".

Hell, ditto freaking Michigan (state where I, a cishetoldfat whitedude, was born) I mean...not exactly a border state? But some wypipo gonna wypipo in the most curious ways.

Yeah, I know. One of the Jan 6 assholes was a Delawarean--my home state--who was seen prancing about with a Confederate flag in the Capitol.

I, an idiot, moved to WV from VA in the 90s precisely because WV was supposedly anti-confederate. The egg on my face right now

Interesting enough, it also started because the Southern states were convinced the Northern states were wussies who would not fight. And then would not fight for too long.

“They will surely surrender quickly” seems to be the Famous Last Words of a lof nations over time.

The biggest winner of all this is the lawyers who get paid to file this crap.

paid by Missouri taxpayers.

Our AG is such a vile person. He'll probably get a cabinet post.

Gather… your… attorneys.

Yale Law prof Jed Rubenfeld has been defending the suit on the other site (even claiming credit for the idea). Even if this wasn't legally ridiculous, there is no way SCOTUS will sign off on this b/c it would mean WAY more work for them.
Avatar
I see where he talks about the other gonzo Missouri suit (re: social media), but not this.
Avatar
It was 11+ days ago, when the threat of the filing originally made news. This is what I posted at the time, but I didn't include a link to Xitter - sorry. bsky.app/profile/core...
Just saw on the other site that Jed Rubenfeld (sexually harassing Yale Law prof with regressive views about rape) has endorsed this lawsuit (even saying it was his idea). I stumbled into having the ideal scholarly nemesis - he manages to be wrong about everything.

There's nothing in that text which demonstrates Missouri's standing to bring suit.

And this matters now because ... ?

Hell, one of the few things that the Supreme Court did not totally break was standing!
Avatar
Avatar
Sure, but if they were going to wreck it, this was the term to do that!
Avatar
I’m not sure they’ve cleared the shadow docket yet.
Avatar
I’ll presume you can look up the definition of “standing”.
Avatar
I'm a member of the Supreme Court bar. I'm asking you why, in 2024, you still think it's a barrier here.
Avatar
And, since you're a member of the Supreme Court bar, I'm asking you why it isn't.
Avatar
Standing requirements have seemed to be pretty darn malleable of late.
Avatar
It's probably designed to force an intergovernmental dispute up to the Supreme Court so they can rule that red state laws count more than any blue state law and automatically Trump them in a 6-3 ruling.

The Freudian slip was better

this is filed directly with SCOTUS under original jurisdiction.

More of these to come, thanks to the fascist groups funding this nonsense
STATE’S RIGHTS ! (to limit other state’s rights)
Avatar
I’m actually shocked they admitted they don’t have the authority and/or power to invade New York.
Avatar
I don't think they want to pay the tolls on the Thruway.
Avatar
Not that I have any actual hope of such a thing, but this is so frivolous as to be (in a better world) sanctionable.
When you go crazy, all crazies think now's their time. No thank you Supreme Court. The movie will be, "Dude, Where's the Standing", sequel to "Dude, Where's my Car"?

ORIGINAL JURISDICTION BABY LETS GOOOOOOO
Avatar
Blue states need to sue red states for... where to begin...
Avatar
When was the last time a state sued another state?
Avatar
That happens a few times each term; it's often over things like water rights, interstate compacts, weird border/jurisdiction issues. See. e.g., the attached.

Letter of marque is the only solution.

+10 to anyone who recognizes that letters of marque and letters of reprisal are to different things!

Is that “prayer for relief” language a legal term of art in Missouri or are they just openly flaunting their disbelief in the separation of church and state?
Avatar
That's common language in legal pleading.
