This is marvelous. Class action alleges Walmart systematically puts one price on the shelf, and charges a little more at the cash register. Walmart claims consumers can see the prices actually charged, so no harm. CA7 rejects. www.law360.com/securities/a...

Walmart does this. It has happened to me. You can go through the ordeal of having someone dawdle back to the shelf, verify the price, and pay what's on the shelf, leave the item, or grumble to yourself and let them steal that extra few cents. Also, you can't trust their per-ounce prices.

Maybe this is noted later in it, I'm too tired to read through right now, but you also *can't* take your receipt or groceries back into the aisles at most Walmarts. They check your receipt at the door on the way out, you leave, and if you come back it had better be empty-handed. Because shoplifting.

A refutation of the assumptions of classical economics…in the Seventh Circuit?! The court of Posner and Easterbrook?! There is still hope in the law!

Posner seemed to come back to real life economics. I think he got upset with billionaire scams

Meanwhile in Canada: If the scanner has a different price than the shelf price, the item is free (if it costs under $10), and if the price is over $10 you receive a $10 discount.

True. Although in Australia price tags show the GS-inclusive price. My understanding is that US price tags mostly exclude sales tax, which you get to discover at the check-out.

I feel like this really enables the whole scam, because consumers are so used to prices not matching they assume its their own maths skills that are lacking

OMG. Ludicrous. And giving me vicarious shame for lawyers who have none

Looks like your work helped the court get to the right result @vanloo.bsky.social !

Hey! This is bananas: the link in this skeet is not accessible unless you sign up using a “non-free” email address, whatever the f that is. Should we file a class action law suit against Law360?

I've noticed this *so* many times.

Most of the time, I just check out and go. But I've left my stuff and walked out on a few occasions.

That's fraud. Daylight robbery.

Wonder what would happen if someone called the police re theft. And the local TV news. And/or made a video of it all for an online expose. Or if any of that actually happened. In the meantime, is it known whether Walmart has ceased to steal from customers?
