wild to me that "leave it up to the states," a view that was used to excuse and legitimize slavery AND SPARKED THE CIVIL WAR, is being cast as "softened" in the context of abortion, like it's fine, we'll just have HALF THE COUNTRY prosecuting abortion as homicide, as a soft, moderate compromise

I hesitate to draw one-to-ones here because I don't think it's strictly appropriate or applicable, but the mainstream/beltway/legacy media's wholesale laundering of "leave it to the states" as a "moderate" position demands some kind of historical perspective!

Side note. I attended law school in the late 1980's (yes, old). In my crim. law (or it might have been torts) class we examined a case in which the defendant struck and killed a woman who was pregnant with his car. The question was whether he also was liable for the death of the fetus. (1/ )

The answer from the court was definitively "No" because the fetus was not alive. I mention this because anyone who's been to law school knows that the cases you examine, especially as a 1L, usually represent settled law and many are decades old (I don't recall when this one happened.) (2/ )

that's what struck me as really disquieting, as advocated by Trump during the debate. "It should be up to the states" as if that's the most reasonable thing in the world. As if uteruses suddenly work differently if the law changes,

as if the needs of those who are able to bear children isn't universal, as if the law *shouldn't* be federal, as universal as possible. I resent how that simple logic wasn't used and "leave it up to the states" wasn't called out and immediately clowned on, let alone in a coherent and lucid way.
