It’s still balls and strikes if you rule that Democrats throw only balls and Republicans throw only strikes.

I'm obligated to post this whenever a baseball metaphor is dropped.

John Roberts is Angel Hernandez.

Ds playing with whiffle ball bats, Rs with Louisville oak.

Louisville sluggers are made of birch and maple. So are you saying R’s are making shet up again?

I feel we should have seen the writing on the wall with Citizens United; the fact we didn't feel the urgency then is forever maddening
Avatar
Gore V bush was the opening salvo really
Avatar
yeah - somehow folks don't remember that roberts, kavanaugh and barrett were part of the brooks brothers riot? wild
Avatar
True, but Citizens United was the tipping point. And many people pointed this out at the time.

Back then we were all like, okay well I guess they had their reasons, now we know better. Todays SCOTUS doesn't use reason, the constitution, originalism,or anything to make decisions, they make decisions now to 'get even' with those who call them out for the corrupt venal unelected clerics they are.

It’s absolutely bonkers that they ruled that there’s absolute or presumptive immunity, with no consideration of motive, for official acts. It’s entirely possible to corruptly perform official acts to, say, obstruct justice, and now the president is immune from any of those crimes.
Avatar
There needs to be massive public protest. No idea how something like that gets rolling but the moment really demands it.
Avatar
What if Joe Biden actually just did something for a change?
Avatar
I’ve seen so much said about Roberts’ apparent drive to maintain a respectable legacy- and like, nope, he clearly never cared at all about how he’ll be remembered
Avatar
He cared because he thought maintaining the court's reputation was important for the conservative political project. The fact that he no longer thinks this is necessary is pretty terrifying.
Avatar
Damn. I think you’re right and I bought in like a sucker.
Avatar
I compared him to a sentient wrench asking "how tight you want it, boss?" (Or maybe Daryl Strawberry vis a vis Mr. Burns)
Avatar
I guess Republicans don't hate activist judges after all.
Avatar
lol of course not, as long as the judges are active about imposing their fascist ideology

When Roger Taney looks like a model of restraint.
Avatar
Taney's actions did cause Civil War I. Roberts is out to continue the tradition Taney set.
Avatar
Yes, I think we are headed that way
Avatar
I don’t really see the point of having one now.
Avatar
If only somebody could unilaterally do something to stop them without repercussions. Oh, wait, there is now…
Avatar
The fact that Roberts cut his teeth in the 80s gunning for the VRA under Rehnquist is just incredibly revealing
Avatar
McReynolds at least had a fig leaf of a legal argument and precedent on his side, and he didn't think FDR could order him killed without fear of prosecution.
Avatar
Yeah, McReynolds et al were assholes but they were defending (bad) precedents from the Lochner era. This group? Even he'd be amazed at the brazen contempt

Still wondering what my former law school is going to teach next semester, maybe Con Law is no longer a required course because it's the scholarly equivalent of VCR/Betamax repair
Avatar
Avatar
Con Law casebooks will now consist of the few paragraphs of Plato’s Republic in which Thrasymachus argues that justice is the will of the stronger, and the Wilhoit aphorism in 48 point type.
Avatar
It's just Hobbes' Leviathan now

As of this morning, no high school US Government class has accurate textbooks …

Ultimately it's Democrats' desire to maintain the perception of legitimacy on the part of the Court which will hamstring them. Actually going out there and calling the Court what it is - an unelected political actor of last resort - is destabilizing. No moreso than presidential impunity, I think.
Avatar
Got to hand it to Roberts. He played the long game here and ended up making himself the most powerful person in the US. And, to even make himself look like a “moderate” in comparison only makes it more insidious.
Avatar
You might remember, as I do, the two Trump impeachment hearings, where CJ Roberts officiated. He sat there like a bump on a log, not saying a word or even lifting any eyebrow when Trump's attorneys like Pat Cipollone, Robert Ray and Pam Bondi spewed lies. What was he even there for?
Avatar
Congratulations, Roger Taney. You and your Dred Scott decision can now step aside for the Roberts Court and Trump immunity.
Avatar
I just wish Biden would be our Lincoln. Sadly, he does not appear to have that interest.
Avatar
@jbf1755.bsky.social @hcrichardson.bsky.social Would sure like your thoughts on this. Lincoln did some pretty radical stuff in his day to save the country.
Avatar
Not to add more discourse to the world but today feels like a good time for any Democratic SCOTUS Judge to consider retiring so Biden and a Democratic controlled Senate can appoint some 25 year olds.
Avatar
Manchin might be a stick in the mud about it but they could still lose him and have Harris confirm, maybe?
Avatar
Y'all talk like Sinema isn't still a Senator
Avatar
Oh I have no doubt short of her being the nominee she would make everything a million times harder, but could be swayed enough
Avatar
Today's ruling gives Biden a whole new set of options to persuade both of them.
Avatar
The damage is done. We will have to suffer for at least a generation. The Repturds are successfully dismantling our Democracy.
Avatar
Biden and every democratic candidate need to run on court reform. It would be popular and necessary.
Avatar
Posited until today that John Roberts would go down in history as the Chief Justice at least as bad as if not equal to Roger B. Taney. He has now exceeded Taney.
