It's not their fault that their dissent is impotent.

No one said it was their fault. But many elected Dems will take the same course as the dissenters on the bench (which is saying words, however “fiery”, and a distinct lack of meaningful action)

Write a dissent that just says, “This is a fucking coup. This is literally a coup and my colleagues in the majority need to be impeached and removed before our country loses democracy itself.”

They can demonstrate the severity of the situation and do something useful beyond the perview of their jobs (just as we’re expected to do): talk to press; talk to voters; make statements at Congress; appeal directly to the president, etc

Yes it is. That's the great thing about living in a representative democracy: it is ALWAYS your fault. You never, ever, not even once, get to blame anyone but yourself for the failings of the system. If you think it's not your fault, you simply are too weak to see what you REALLY needed to do.

Could you show me where the Leahy laws allow for criminal prosecution? Anyway, there's nothing Biden can do without Congressional support.

No. They left a very small window for Smith's prosecution, which will take years to resolve before they say "nah, Trump's immune."

structurally all of them are impotent given that they are in the minority. essentially they are [sometimes] strongly written letters.

Trump v Vance, apparently potent dissent in that what only Thomas and Alito signed on to four years ago is now the supreme law of the land today

Sure, but under that rubric no dissent can be declared potent or not until we’re looking back from the end of time, so it’s not super helpful in the moment.

I am missing your point about when a dissent is worthwhile, or you are making an unrelated point that I do not see.

A dissent is always worthwhile to those who agree with the dissent. A dissent may be potent because it can shift the debate and even be cited in a majority opinion going forward. I think today’s decision would have been less likely but for the dissent in 2020
