Amazingly, this could refer to (a) CO Supreme Court ruling Trump ineligible for primary ballot because he "engaged in" insurrection or (b) Judge Chutkan's ruling Trump doesn't have "Presidential immunity" for his actions after the 2020 Presidential election.
SCOTUS will have cert petitions on both.
This would also have the added benefit of allowing Gorsuch to take his long-planned xmas Aspen ski vacation, which we all know is critically important.
Hmmmm…. Suddenly feeling more possibility.
To do otherwise is hypocritical considering that they have already ruled that states control elections 100%. If a state wants to gerrymander, wants to close polling places with people still waiting in line, wants to give an entire city one polling place with no bus access and no sidewalks, they can.
Raffi, I enjoy your posts so much that whenever you post something fascinating over on the other site, I get jealous because I want to be able to repost it here (I'm thinking of your Baude post and the Andrew Edison Xmas order)
Trump isn't ineligible because he broke the law. He's ineligible because he violated his oath to the Constitution. The president serves for 4 years. Trump lost and schemed to remain in office after losing.
It's not complicated.
Prediction: “Stop the votes! The way to enrich democracy is to quit counting when we say so. What? Voting hasn't begun? Stop counting the votes of state supreme court judges. That sounds like 2000? Who cares - we’ll get the result all true red blooded Americans want, just like last time.”
Serious question: why should conservative SC justices protect Trump? Protect Republicans and their policies, yes. But do big money R donors really care about Trump?
If Trump becomes dictator, there is no point in having a Supreme Court, and they are mostly smart enough to realize that. The Supreme Court is also pretty protective of their own power, historically
The original poster was suggesting that they were bought and paid for by mega donors whose goals may not align with Trump's. Also, they are only valuable to the extent they have power. Why give away their power?
