So WV has introduced a bill that would, de facto, make being transgender in the state of West Virginia a felony. Say hello to Senate Bill 197. This is... horrifying. I might have to evacuate this state if this gets anywhere close to passing.

Not only using the incorrect term/slur, but I'm betting they have sections that would include same-sex PDA as "exposure." They're not going to stop until they hit the T, the B, the G, and the L.
Avatar
I'm not sure they wouldn't include not passing in public as an infraction
Avatar
the uh, multiple negatives in this make this sentence incomprehensible
Avatar
cancelling them out, you get something like "I bet they're gonna try to make it illegal not to pass"
Avatar
once they realize that passing exists they'll make another law defining passing as a crime also
Avatar
It's already legal to murder someone for passing in some states so yep
Avatar
I'm missing a lot of context here but based on just the wording in the screenshot alone, wouldn't it already cover passing? It's any transgender exposure or display at all.
Avatar
Gender fraud or something stupid
Avatar
ah yeah no need to bet, just read the post that started this thread :P
Avatar
they're saying tgat it's likely that the type of bigot that would propose a law like this is likely to classify trans people who dont pass as in violation
Avatar
Also trans people who DO pass. Either way, "they can always tell." And they haven't rolled things back to interracial couples yet, but they sure want to.
Avatar
Right but that's not what the post they were confused about was sayin just in the post
Avatar
The way it's worded feels like a lot of arbitrary enforcement would follow, and so, in a functioning democracy, it could not pass. Is WV a functioning democracy?

No* *Source: I am a WV resident.

Other states will follow even if it doesn’t pass in WV. So many anti trans laws on the books.
Avatar
I had to think about it, but it was wasn’t incomprehensible to me; I thought it was done to highlight the “unintended” consequences (which were totally intended).
Avatar
Not to defend the bill, but if I'm not mistaken, some people do legitimately ID as transvestites.
Avatar
Usually these are people from previous generations who grew up with that phrase and it means something to them, and if anyone tells me I should tell a Queer Elder that they’re not self-identifying properly, you’re getting a slap from me and two for my ancestors.

It’s because I’m a crabby middle-aged queer who grew up identifying as bisexual and is sick to death of younger queers informing me that I’m *actually* pan or calling me transphobic for using bisexual and I just…I will smack them with my bright purple cane with the trans flag on it.
Avatar
Same. Bi person married to a trans person here so explain that one, ahistorical kiddos.

I understand that some people use it in a derogatory manner but I've seen people that identify that way and I don't see how them identifying as such is anti-drag? Many people also still use "transsexual".
Avatar
I am of the mind that all good faith queer IDs are acceptable so I just want to make sure we're not alienating people by calling their identity a slur/incorrect.
Avatar
Oh no sorry, I meant that the bill is written so that it can be applied to drag performance, as well as for someone trying to pass, for any trans person, and I guess for any woman who wears pants? Maybe men in kilts too?
Avatar
Sorry, I'm not going to give people writing anti-trans legislation a pass for "maybe using it because some people are OK with it" and not just being bigots who have no idea what they're talking about.
Avatar
Yeah that's not at all what I'm saying.
Avatar
Which is so loosely written it targets transgender people
Avatar
It's so loosely written it bans transgender people from being out in public lest a child see them. It's almost so vague that it would mean anyone not easily identifiable as male or female by a child would be charged with indecency.
Avatar
I get tired of people saying the cruelty is the point, and then I remember it absolutely is. The idea is to keep people frightened and ashamed.

I'm so tired of cisgender people accusing us of worrying too much when the GOP is now proposing bills that are HARSHER than the anti-crossdressing laws that were weaponized against us in the 1960's.
Avatar
Yeah I really don't think people are going to believe this is real until it completely explodes

Probably because they’re not directly facing such blatantly evil laws themselves. Sure, the abortion ones are escalating, but that mostly affects the women portion of cisgender people, not all.

not just being transgender, people who look androgynous, women who look "masculine", and men who look "feminine" will basically have their entire existence outlawed. Even women who wear pants could be targeted. This bill has the potential to deal out a massive wave of damage if passed.

Here's a link to the complete bill text, which also has a link to the updated bit of WV code. Alas, context doesn't make it any better. www.wvlegislature.gov/Bill_Status/...

“The purpose of this bill is to prohibit obscene materials in West Virginia schools” People are materials now?

THANK YOU! I couldn't find it for some reason
Avatar
It took me a while, too, until I remembered that lol, it's 2024 not 2023 now, no wonder I'm finding the wrong bill

yeah, doesn’t help that the WV legislature site is 20 years old
