Same. But the maine one brings up a good point that someone else that was denied being on the ballot for insurrection did not have a court case charging them with insurrection. So it's clearly not needed.

Now that we have two states doing this, Trump team will absolutely put pressure on purple states like Florida to block Biden from the ballot for whatever reason someone like DeSantis can make up. Like Biden once farted in his general direction or something.

They (and the news unfortunately) will pretend the made up “crime” that DeSantis or Abbot pretends is a thing is equivalent to the real and serious crimes that Trump committed.

Yes, but it's more like a too-cute-by-half argument that because Trump CLAIMS to have won in 2020, sounds like he's telling us he can't run again. So more an accusation of hypocrisy than a legal argument.

Or to put it another way, because he claims to have won in 2020, his assertion that he is qualified to run in 2024 is false, and so constitutes perjury.

That wasn't the argument made by the objector here, and perjury isn't a disqualifying factor under the 14th Amendment (nor am I certain what body he is meant to have perjured himself before)

I will admit that I only quickly skimmed the SOS order, but my impression is that she is only barring his presence on the ballot because of this, not necessarily claiming he is ineligible to hold the office. Splitting hairs. And IANAL.

It doesn't. I doubt the person who filed it believes that Trump actually won in 2020. They're just doing a little trolling - if this argument had been accepted and Trump had to fight it, he'd have to admit he lost in 2020 and therefore the 22nd amendment doesn't apply to him.

Okay yeah, it says in the ruling that they questioned Gordon and he admitted that Trump did not win the 2020 selection. So definitely not a matter of someone who actually believes Trump won.

They're saying that, by insisting that he actually won the 2020 (another says 2016) elections, he has disqualified himself. That he is wrong is separate from whether he has said it. It's basically pushing for him to either admit on record that he didn't win those elections, or be disqualified.

I know SCOTUS will end up ruling something to the effect of, “Well, he hasn’t -actually- been convicted of anything, so he qualifies,” but I’m enjoying this in the meantime. I also expect Thomas’ concurring opinion to be to the effect of “the 14th Amendment is stupid anyway.”
The problem with this is we have stopped someone from being on the ballot for insurrection and they never had to be convicted of anything for it. There's actual precedent

I know, but this is exactly the kind of situation Trump wanted his loyalists on the bench for. This SCOTUS in particular has shown it’s more than happy to reinterpret or ignore precedent as long as the outcome serves conservative goals.
Well, the interesting part with that is John Roberts has spent a lot of time arguing and putting out decisions that insist elections are handled at the state level. So he'd be overturning his own precedent and rulings too lol.

The courts aren't ruling that Trump can't run for President in 2024. They are ruling his actions rose to the level of insurrection & rebellion. And to be eligible to run for office, Trump needs to seek a vote in Congress, per the US Constitution.

This is dumb. 70% of the GDP comes from the metro areas in the US. Trump won 4 of the metros, all except 4 metros swing left from 2016 to 2020. Even in red states, the blue metros power the economy. Where would the red states come up with the funds to even fight? The RNC can't even raise money!
