Here’s the thing about the Vance pick: it’s probably unhelpful in electoral terms. But, in terms of governance, it’s further evidence that they’re Going For It. Trump 1 was hobbled in his authoritarian attempt by the admin and GOP. Trump 2 will be aided by both. They’re gonna go for it.

A fun fact about JD Vance is that he's openly backed purging anyone who disagrees with him from the government, comparing it to "de-Nazification," and illegally defying court orders to do so.

Institutions work until they don’t. It’s banal but true. Courts as institutions worked when Trump tried to steal the election, but FedSoc has been chipping away at them for decades, and I think it is very rational to doubt they will work any more to restrain an executive.
WSJ this morning. lol at the last bit. "Leaders on both sides need to stop describing the stakes of the election in apocalyptic terms. Democracy won't end if one or the other candidate is elected. Fascism is not aborning if Mr. Trump wins, unless you have little faith in American institutions."

This is not terrible news. There was already no way this case would go to trial in 2024. This (pretty out there) decision will be appealed & decided de novo, & if the appeals court reverses & reinstates the charges, it has the option of reassigning the case to a different judge.
Judge Cannon went and did it. She has dismissed the stolen documents case against Trump on Clarence Thomas’s (nonsense) appointments clause rationale.

I think this is having a real effect. I know some reporters might think it's "political" to call for getting off the platform, but really they are making a radical, political choice by staying.
I’ve said this a million times, but I’m genuinely frightened about what Musk’s fascist propaganda network is doing to do to our politics. I really wish someone, anyone, would come up with a collective strategy to get journalists, organizers and elected officials off the platform.

The central thesis of the case here is just ... wrong. That's not the crux of the dispute. USG always always always maintained official acts are immune and non-official acts are not. That's the easy bit. The hard bit is deciding if an act is official, and SCOTUS just punts on that actual core

Two immediate thoughts: - Presidents have been able to get away with *a lot*, so to some extent, this codifies the (very, very bad!) status quo - BUT ALSO: To officially codify presidential immunity in this way, with reference to this specific situation (an attempted coup!) is utterly terrifying

The presidential immunity case this morning should be galvanizing and should shut all of the "replace Biden" people the fuck up. We *have* to stop Trump, especially a Trump who will have been let entirely off the leash by this decision, and he's the vehicle we have. Don't like it? Don't care.
I really have lost my former tolerance for "we're doomed/fucked/it's all over/they've won" takes at this point, in that they're the most dangerous attitudes one could possibly have when confronted with a truly existential political threat (which we still DO have levers to address).

This is the ball game folks, the authoritarian green light laid out in advance. Congress will not impeach Trump. And SCOTUS now blesses him with extraordinary latitude to do whatever he wants in power. A second administration will not be constrained by Congress, the courts, the bureaucracy or law.
Trump, who tried to overthrow an election, campaigned persistently for his fellow party members to grant him absolute immunity for his misdeeds in office. And they did. If you can't distinguish between "energy in the executive" and a constitutional crime spree, you've given up on US democracy.

I'm reading the opinion and it says he enjoys absolute immunity regarding threats to fire the attorney general if they don't do what he wants. So, he could easily just say "investigate or prosecute my friends and you're fired" and he's 100% immune, right?
