/2 I’ve generally been an institutionalist. Lawyers kind of have to be or else being a lawyer is basically playing Dungeons & Dragons in uncomfortable clothing and without snacks. But there’s a line where courts no longer suffice as an institution to stop totalitarianism….

Institutions work until they don’t. It’s banal but true. Courts as institutions worked when Trump tried to steal the election, but FedSoc has been chipping away at them for decades, and I think it is very rational to doubt they will work any more to restrain an executive.
WSJ this morning. lol at the last bit. "Leaders on both sides need to stop describing the stakes of the election in apocalyptic terms. Democracy won't end if one or the other candidate is elected. Fascism is not aborning if Mr. Trump wins, unless you have little faith in American institutions."

Quick points: 1) Assassination attempts are bad, period. 2) We do not know the motives of the shooter. 2) We do not know the political consequences of this event. There were attempts to shoot Teddy Roosevelt, Gerald Ford, and Jimmy Carter shortly before elections; they all survived and lost.

Just a reminder: it’s good to oppose assassinations. But you are under absolutely no obligation to treat Trumpists and Trump-apologists as people who are honest, or acting in good faith, when they purport to condemn political violence or violent rhetoric. They’re not sincere.

As a staunch opponent of political violence, I greatly prefer when national leaders respond to it by condemning violence and expressing concern for victims (image 1) rather than encouraging violence and laughing at victims (image 2).

Biden uses public power in the public interest. You might have some alternative legal/economic theory of how to achieve the public interest could be served, but Biden is operating according to a principled approach. Trump wants to use public power to solicit political support and attack his enemies.

I mean, realistically I could absolutely get stolen by the fae, but only if they bothered to go as specific as “a bird who looks like it might be unusual, keeping juuuust hidden enough and flying short, easily walkable distances…” I’m actually surprised more birders aren’t, now that I think of it.

Trump campaign is very smart in that they’re feeding the “Biden is incompetent” fire through so many back room connections and press deals, that the Biden team has no time to do basic opposition campaigning. Trump is a fucking convict and the Biden team can’t come up for air long enough to say it

jesus, at minute 22 he starts digging in on trump and just absolutely gores him deep over and over again, people talk about trump as if he's the only one ever able to score any points, but biden's calling trump a criminal, a rapist, an idiot and a traitor to absolutely *ROARING* applause

this is literally evidence that he is still sharp. people with significant cognitive decline don’t catch flubs like this in real time. people with dementia don’t catch them at all. it’s like calling someone feeble who tripped over a curb and regained their balance without falling.
Now everyone--The Times and, sorry to say, MSNBC--is noting every missed syllable. The man has a stutter. I don't stutter but I am a mushmouth who speaks too fast and slurs words. I've had to overcome fear of public speaking. I have empathy for Biden. The press has empathy for no one (but Trump).

The IRS reported this week they collected $1 BILLION in taxes owed by rich tax cheats thanks to the Inflation Reduction Act funding that provided them the additional staffing to pursue these cases. First up on the GOP agenda for the next administration is gutting the IRS.
billionaire wealth in the US hit 6 trillion today, an all time high, and that’s double what it was before trump-gop passed their tax bill in 2017 that accelerated the rich getting absurdly insanely richer

March 23 1933, the Enabling Act becomes law in Germany, giving the chief executive power enforce his own laws without checks and balances. The passing of the Act marked the formal transition from democratic republic to totalitarian dictatorship. 6 months later, it was a 1 party state.

I'll point out that Napoleon staged the military outside of the General Assembly at one point and prevented political opponents from entering in order to pass legislation. Under the SCOTUS ruling, it seems like a president could do the same and be immune due to being the C-in-C.

“If they can convict a president for breaking the law, they can convict anybody!” Right, that’s the whole point. Our laws actually apply to everyone. Congrats on just now figuring out how that works.

OK, I’m going to rate the “Clarence Thomas attacks Brown v. Board of Education” as misleading and inaccurate. (Also, even under the most aggressive interpretation, he was attacking Brown II, not Brown I).

Since Wednesday, Columbia University has refused to allow credentialed reporters access to the campus. Now it has locked up the campus too. (Many gates now sport bike locks.) The J-school has been helping credentialed reporters to get on campus. Email [email protected]

We don't talk about this enough, but if Trump wins, he will do everything possible to repeal Biden's climate policies. On the pod, @volts.wtf volts is incredibly informative on how disastrous this would be. He also explains a concept called "petro-masculinity": newrepublic.com/article/1808...
