Pretty much confirms my suspicion that the Biden-Is-Old news cycle was mostly a product of summer doldrums, which is a pretty fucked up thing given that there has been plenty of other news in the last month.

But it really strikes me as missing the point. If Trump wins the case is over as soon as he wants it to be. If Trump doesn’t win there’s no likely path that doesn’t end in SCOTUS (at least as presently constituted) saving him on some bullshit. What, are we going to run out of vulgar Winnebagos?
Josh just asked me about this and will again on the show this week. My sense is that though the 11th Circuit will reverse if they ever get it, they won’t use this as an excuse to remand to a different judge.

The day of the immunity decision, I resigned myself to Trump not facing legal consequences for any his political actions (including the NY criminal case). A part of me felt it was hyperbole to think that, but I'm not sure.

Judge Cannon went and did it. She has dismissed the stolen documents case against Trump on Clarence Thomas’s (nonsense) appointments clause rationale.

Yep. There's a lot of wiggle room in law, a lot of places where a judge's general attitudes about law, politics, governance, etc, will sway them to reach one of many potential outcomes. That is not what is happening now. What is happening are hacks and lunatics deliberately misapplying the law.
I'm a big fan of the attitudinal model of law, but I also think it's possible for judges not to be total partisan hacks. The thing is, literally no institution could survive if its leaders were taking bribes and its major positions were purposely filled with irresponsible lunatics for decades.

In all seriousness: the very idea that someone can take highly classified documents, store them in a public place, defy any number of requests, subpoenas, etc., and then face NO CONSEQUENCES AT ALL is genuinely shocking, and should terrify anyone who cares about national security.

This is a good point. She could have waited until after the election, or after a jury is empaneled. It smacks a bit of mask-off triumphalism, a sort of HA WE ARE WINNING TRUMP 4EVER BITCHEZ, which may be an accurate perception of the drift of things, or not.
The only thing that surprises me about what Judge Cannon did is that she did it this soon, on grounds this likely to be overturned.

Institutions work until they don’t. It’s banal but true. Courts as institutions worked when Trump tried to steal the election, but FedSoc has been chipping away at them for decades, and I think it is very rational to doubt they will work any more to restrain an executive.

A serious attempt by legislators or a candidate to invalidate a plainly valid election to install someone who plainly lost the election as president is not a "legal hack" or "finalizing results". Yep, and this one is easier still: it's in Louisiana, which means the Fifth Circuit, which routinely flouts precedent. If they allow it, the six GOP SCOTUS Justices can just deny cert and let it stand without getting their hands dirty.
